前几天有网友问及下面句子中的would have done是虚拟语气还是情态动词推测性用法：

He will give his workers three days off, but only a decade earier, such an act would have required legislative approval in Virginia.

They are recycling things they would have thrown away in the past.

我和刘老师在回答这个问题时，都认为这里的would have done不是虚拟语气，而是情态动词的推测性用法，即说话人对过去的情况进行推测。

现在回顾这个问题，我觉得这二个句子中的would have done其实都应该是传统语法中的虚拟语气形式，即含蓄虚拟条件句，if从句没有明确表示出来，但完全可以补充一个if虚拟条件句。

故我再次提出这个问题，请老师们发表看法。
