定从的用法疑问(, who having it... )

句子比较长,老师辛苦了: 

 Suppose an occasion to arise, in which a suspicion is entertained...  that at this very time  a considerable number of individuals are actually suffering, by illegal violence inflictions equal in intensity to those  which if inflicted by the hand of justice, would universally be spoken of under the name of torture. For the purpose of  rescuing  from torture these hundred innocents,  should any scruple  be made of applying equal or superior torture,  to extract the  information from the month of one criminal, who having it in  his power to make known the place where at this time the enormity was practicing or about to be practiced, should refuse to do so?   

问题一:who having it 怎么理解? 

问题二:equal  to those which if inflicted中which if部分怎么理解?这貌似是个定从,但是if不理解。

who和谓语should refuse之间,插入了现在分词短语作条件状语。

which (if inflicted by the hand of justice, ) would universally be spoken of under the name of torture.

which和谓语would be之间插入了条件状语。

For the purpose of rescuing from torture these hundred innocents, should any scruple be made of applying equal or superior torture, to extract the requisite information from the mouth of one criminal, who having it in his power to make known the place where at this time the enormity was practicing or about to be practiced, should refuse to do so?红色部分是网友省去的部分,从网上搜到并补全了。我对这段文的大概理解是:
