"based on"是分词短语还是介词短语？

I don't judge people based on race,creed,color or gender. I judge people based on spelling,grammar,punctuation and sentence structure.

请问这里的"based on"短语是属于分词短语？还是类似于"according to"的短语介词？

没有理由把based on分析为介词。词典好像也没有based on作为介词的词条。
