with sb/sth doing sth中的doing是现在分词和动名词并不是固定的吗

同时我有一个疑问：是不是 with sb/sth doing sth这个结构中，doing 到底是动名词还是现在分词并不是固定的，需根据实际情况来确定？如果是，那有什么确定的相关规律和判断方法吗？谢谢专家！

在 with sb/sth doing sth 这个结构，doing 是现在分词。依据如下：

1. He went to the party with his shoes shining and creaking.

此句出自张道真的《英语语法大全》，该书认为这里的 shining and creaking 是现在分词。

2. With his food running out, the man had to come out of his hiding-place.

此句出自薄冰的《薄冰英语用法问答1144例》，该书认为这里的 running out 是现在分词。

判断方法如下：

(1)如果是with/without 的复合结构，则为现在分词

I couldn`t finish my work with those children playing around.

With winter coming on, the trees turn yellow and some birds fly south.

With prices going up so fast, we can’t afford luxuries.

He kept the money without anyone knowing where it was

(2)如果是介词with/without +动名词的复合结构，则为动名词

He walked into the house without us seeing him.

He entered the room without being noticed.

He left without saying goodbye to us.
